President Obama's open government?

"FOX Business Network has won a victory against the Treasury Department in its Freedom of Information Act request for details about the government’s bailout plan" (Fox Business).

President Obama promised openness in government under his administration. If his government is so open, why did Fox Business have to go to court to get something that should have been available under the Freedom of Information Act?

If Obama's government is so "open" then why did his first press conference run according to a pre-determined list of reporters; and the rest were there to listen but not speak.
